Here is the contract that you will have to sign when you agree to commission me.  *Note*  Don't print out this version of the contract to send back to me.  This is just for you to look at if you're thinking about commissioning me.


Please read and understands these before signing and returning this contract; thank you!

 

 

THE REQUIREMENTS BEFORE YOU COMMIT TO STARTING A COMMISSION:

 

1. You will be in charge of providing the reference materials; either through regular mail, e-mail, or instant messengers (contact information is available in the Basic Information section of the website).  Please be specific about what it is you want made, and don’t assume I know anything about the character or show you’re requesting from.  Also, if you need me to do the research for you, there will be an extra fee attached (contact me if you have this requirement before signing).

 

2. You must specify your deadline. Do not just give me the date of a convention and expect me to know when it is (especially American conventions because I live in Canada); so please tell me when it is being held.

 

3. If you would like for your commission to be made out of something in particular, tell me, and I will do my best to accommodate it.  If you do not have any particulars, then it will be left up to my discretion.   Also, if you like/dislike certain types of fasteners, please tell me (I usually use Velcro and snaps).

 

4. Depending on what you commission from me, I may/may not need measurements from you.  Also, please make sure to tell me the right measurements; or else certain commissions may not fit.  I will usually add a bit of leeway to the items, but they will not always accommodate if the measurements are way off.

 

5. Please give me at least a month's notice before you need an item for a convention; more would be appreciated.  For any sort of wing commission I would like to have three months in advance.  Some items that I have already made once are the exception to this, and I may be able to do them in a shorter amount of time.  I may be able to do rush orders on some objects, but there will be an extra 10 % fee on top of the costs (again, contact me before signing if you need a rush job).

 

6.  On commissioned items, I will send you in progress pictures at least once during the process (how many updates you get is dependent on how large the commission is).  As soon as you receive the pictures, please contact me to either tell me if something is wrong, or to just say that it looks fine to you.  I will also send a picture of the finished product to you and ask for the remaining payment before I send anything out.  Please do not send me hundreds of e-mails asking how your prop is coming along.  Checking up once or twice in one week is plenty; no need to send me a message every day.  If I run into a problem with your commission, I will make sure to contact you about it as soon as possible.

 

 

  PAYMENT IS AS FOLLOWS:

 

Before I go ahead and start on anything, I need you to pay 50% of the cost (materials and labor); so that I can cover the cost of materials.  After I finish the commission, I will ask you to send the remaining 50%.  If, for some reason, this cannot be done, contact me before I start the commission and I can arrange a different payment schedule.  However, I will not send anything to you until the full amount is paid. 

 

                The only two forms of payment I accept at this time are PayPal and money orders.  Please make sure that if you’re sending a money order that it is in American dollars and that the signature matches the one on this contract.  Also, if sending a money order, it is very important that it is an International (pink) money order if you are sending it from anywhere outside of Canada.  If sending from Canada, a regular money order is fine.  After your payment is made, the item will be shipped out.

                 

HOW PRICING IS DETERMINED:

 

                As soon as you contact me about a commission, I will give you a quote of how much it will cost.   This takes into account the material cost and the cost of labor.  There will be an approximate shipping cost stated separately (may be lower/higher at the time of completion).  This quote will be exactly how much you will pay for the item; I will not up the price at the end if your item took me longer than expected (shipping is separate).             

 

 

ACCEPTING A COMMISSION BASED ON THE ESTIMATES I GIVE YOU:

 

                If you have decided that my pricing and methods are reasonable and decide to hire me for your commission there’s just a few more things you should do:

 

1. I will send you a copy of this contract (through e-mail) so that you will have a copy of it.  Make sure to keep it somewhere safe.

 

2. I'll print out a copy of the contract as well, sign it, and then ship it off to you.  You are to read it over, contact me if you need any changes, sign it, and then ship it back to me.  If you are paying by money order, please send the first payment with the returned contract.  I will not start on your item until I receive the signed contract and the first payment.

 

3. Please keep records of every conversation and discussion we’ve had (e-mail, instant messengers, regular mail). I’ll keep track of all of them as well.  This is just for your own records and to avoid any problems about ‘he said, she said’ if something goes wrong.

 

4. I have no problems if you wish to compete in a costume with a part I made, but I just ask that you give credit where credit is due.  Even just a little sentence on your entry form is fine with me.   You must inform me beforehand if you intend on competing in a costume with a part made by me.  However, you are not allowed to submit my work for workmanship judging unless I am there with you.

 

 

RETURN POLICY:

 

                I will not be accepting returns on finished commissions or pre-made items. There should be no need for a return as long as you follow my guidelines. I will be sending you in progress pictures of your commission so if you see something you don’t like then, tell me right away before I finish it.  However, if you get your item and it doesn’t fit, then I’ll be happy to fix it at no extra cost to you. 

 

 

SPECIFICATIONS OF YOUR COMMISSION:

 

                This is what you have agreed to commission from me, and these are the terms that we agreed upon.  This is what you will receive upon shipment, so if you see something is wrong when reading it over contact me ‘before’ returning this.  Any changes to the item/date (unless the date is pushed back) will not be accepted after returning this contract.

I, THE BUYER ALSO UNDERSTAND THAT BY SIGNING THIS CONTRACT IT BECOMES A LEGALLY BINDING DOCUMENT FOR BOTH THE BUYER AND THE SELLER.

 

I, THE BUYER DO UNDERSTAND AND ACCEPT THE SELLERS NO RETURN POLICY.

 

I, THE BUYER DO REALIZE THAT THIS IS A BUSINESS TRANSACTION AND REALIZE IT WILL BE TREATED AS SUCH.

 

I, THE BUYER ALSO UNDERSTAND THAT THE SELLER MAY TERMINATE THIS TRANSACTION AT ANY GIVEN TIME IF THE BUYER DOES NOT FOLLOW THE TERMS AND CONDITIONS SET DOWN BY THE SELLER.

 

I, THE BUYER UNDERSTAND THAT WHAT IS LISTED IN THE ‘SPECIFICATIONS OF YOUR COMMISSION’ SECTION IS WHAT I SHALL RECEIVE UPON SHIPMENT.
